SCOPE: FACULTY AND STAFF Issued: 4/1/00

              Superseded: 10/6/14

The Texas State University System (TSUS) and Lamar University are firmly committed to creating and maintaining a learning, living, and working environment free from all forms of sex discrimination, and one where each individual is respected, appreciated, and valued.  Sexual misconduct is a form of sex discrimination and will not be tolerated.  To this end, a System-wide Sexual Misconduct Policy entitled " Sexual Misconduct and Procedures"  has been approved by the TSUS Board of Regents for immediate implementation and supersedes Lamar University Policy Number 2.5 - Sexual Harassment effective October 6, 2014.  This policy defines and describes prohibited sexual conduct, establishes procedures for processing complaints of sexual misconduct, stipulates appropriate sanctions, and identifies available resources.

Sexual misconduct is a broad term encompassing a range of non-consensual sexual activities or unwelcome behavior of a sexual nature.  The term includes but is not limited to sexual assault, sexual exploitation, sexual intimidation, sexual harassment, domestic violence, dating violence, and stalking.  Sexual misconduct can be committed by men or women, strangers or acquaintances, and can occur between or among people of the same or opposite sex.

Lamar University is committed to maintaining an environment that promotes prompt reporting of all types of sexual misconduct and timely and fair resolution of same.  Lamar will take prompt and appropriate action to address sexual misconduct when such is committed, prevent its recurrence, and remedy its effects.
